Access, navigation, and use of the ubica.immo website (hereinafter, the 'Website') imply the express and unconditional acceptance of all the terms of this Legal Notice. Compliance with and fulfillment of these terms will be enforceable against anyone who accesses, navigates, or uses the Website.

Purpose

This Legal Notice regulates access, navigation, and use of the Website, without prejudice to the Owner's right to modify the presentation, configuration, and content of the Website, as well as the conditions required for its access and/or use. Access and/or use of the Website after the entry into force of its modifications or changes imply acceptance of the same.

However, access to certain content and the use of certain services may be subject to specific conditions, which will be clearly displayed and must be expressly accepted by Users. These specific conditions may replace, supplement, or, if necessary, modify those established in this Legal Notice.

For the purpose of interpreting this Legal Notice, it is understood that a person becomes a user (hereinafter, 'User' or 'Users') at the moment they accept this Legal Notice and the Privacy Policy presented on the Website.

Access and Registration

Accessing and using the Website does not require registration. However, accessing and navigating the Website implies that the User fully accepts and undertakes to comply with this Legal Notice, as well as the instructions or recommendations indicated in each specific case through the Website.

In any case, access and navigation on the Website by individuals under the age of fourteen (14) is prohibited, unless they have the prior and express authorization of their parents, guardians, or legal representatives, who will be considered responsible for the actions carried out by minors under their care, in accordance with current regulations. In any case, it will be presumed that the access made by a minor to the Website has been done with the prior and express authorization of their parents, guardians, or legal representatives.

In the event that the User sends information or content of any kind to the Owner through any of the channels enabled for this purpose, the User declares, guarantees, and accepts that they have the right to do so freely, that this information does not infringe any intellectual property, industrial, trade secret, or any other rights of third parties, and that this information is not confidential or harmful to third parties.

The User acknowledges assuming responsibility, indemnifying the Owner, for any communication or content they send personally or on their behalf.

If the User becomes aware of the existence of any illegal, unlawful, or content contrary to the law, or that could constitute an infringement of intellectual property, industrial, or any other rights, they must immediately notify the Owner at the email address info@ubica.immo so that appropriate measures can be taken.

Similarly, if any User or third party considers that any of the content on the Website owned by the Owner violates their intellectual property, industrial, or any other rights, they must send a communication to info@ubica.immo with the following information:

1) Identifying data and contact method of the complainant or their legal representative.
2) Documentation proving their status as the holder of the rights allegedly infringed.
3) Detailed account of the rights allegedly infringed by the Owner, as well as their exact location within the Website.
4) Express declaration by the complainant that the use of the content has been carried out without the consent of the holder of the rights allegedly infringed.

Links

A) Links to other websites

If the Website displays links to other websites through different buttons, links, banners, or embedded content, the Owner informs that these are managed by third parties. The Owner does not have human or technical means to know in advance and/or control and/or approve all the information, content, products, or services provided by other platforms to which links may be established from the Website.

Therefore, the Owner cannot assume any responsibility for any aspect related to the website or web page to which a link from the Website may be established, specifically, but not limited to, its operation, access, data, information, files, quality, and reliability of its products and services, its own links, and/or any of its content in general.

In this regard, if Users have effective knowledge that the activities carried out through these third-party websites are illegal or violate morals and/or public order, they must immediately notify the Owner so that the access link to them is disabled, an action that will be taken as soon as possible.

In any case, the establishment of any type of link from the Website to another external website does not imply the existence of any relationship, collaboration, or dependence between the Owner and the party responsible for that external website.

B) Links to the owner's channel on other platforms and social networks

The Owner makes available to Users, through different tools and applications, links that allow Users to access the channels and pages of the Website maintained on different platforms and social networks owned and/or managed by third parties (e.g., Twitter, Facebook, YouTube, etc.). The inclusion of these links on the Website is intended solely to facilitate Users' access to these channels on different platforms and social networks.

The establishment of these applications does not imply any relationship between the Owner and the owner, manufacturer, or distributor of the linked website, nor the acceptance and approval by the Owner of its contents and/or services. The owner, manufacturer, or distributor is solely responsible for them.

By accessing these external networks, the User enters an environment not controlled by the Owner, so the Owner will not assume any responsibility for the security configuration of these environments.

Since the Owner may have limited control over the content hosted on these channels, the User acknowledges and accepts that the Owner assumes no responsibility for the content or services that the User may access on these pages, nor for any content, products, services, advertising, or any other material available on them.

C) Links on other websites leading to the website

The Owner does not authorize the establishment of a link to the Website from those pages that contain illegal, illicit, degrading, obscene materials, and, in general, violate laws, morals, or public order, or generally accepted social norms.

In any case, Users may establish links that lead to the Website, provided they comply with the following conditions:

1) The link may not reproduce the content of the Website or any part of it in any way.
2) Creating a browser or border environment around sections of the Website is not allowed, nor can the Website be modified in any way.

The Owner does not have the authority or human or technical means to know, control, or approve all the information, content, products, or services provided by other websites that have links to the Website. The Owner assumes no responsibility for any aspect related to the website that establishes this link to the Website; specifically, but not limited to, its operation, access, data, information, files, quality, and reliability of its products and services, its own links, and/or any of its content, in general.

Website Usage Rules

It is not allowed, and therefore its consequences will be the sole responsibility of the User, to access or use the Website for illegal or unauthorized purposes, with or without profit. In particular, and without the following list being exhaustive, the following is prohibited:

The User's breach of any of the above obligations may lead to the adoption by the Owner of the appropriate measures provided for by Law and in the exercise of their rights or obligations, including the possibility of eliminating or blocking the account of the infringing User, without the possibility of any compensation for the damages caused.

Liabilities and Warranties

The Owner cannot guarantee the reliability, usefulness, or truthfulness of all the information and/or the services and content of the Website, nor the usefulness or truthfulness of the documentation made available through it.

Consequently, the Owner does not guarantee or accept responsibility for:

1) The continuity of the contents and services of the Website;
2) The absence of errors in these contents and services;
3) The absence of viruses and/or other harmful components on the Website or on the server that supplies it;
4) The invulnerability of the Website and/or the impossibility of violating the security measures adopted in it;
5) The lack of usefulness or performance of the contents and services of the Website; and
6) Damages or harm caused to oneself or a third party by any person who violates the conditions, rules, and instructions that the Owner establishes on the Website or through the violation of the security systems of the Website.

However, the Owner declares that it has taken all necessary measures, within its possibilities and the state of the art, to ensure the functioning of the Website and minimize errors in the system, both from a technical and content perspective published on the Website.

The Owner does not guarantee the legality, reliability, or usefulness of the content provided by third parties through the Website. If the User becomes aware of the existence of any illegal, illicit, contrary to the laws, or that may constitute an infringement of the rights of third parties, they must notify the Owner immediately so that appropriate measures can be taken.

The Owner will not be responsible for the truthfulness, integrity, or updating of the information published on the Website from sources external to it, as well as of the contents contained on other platforms to which links are provided from the Website. The Owner will not assume responsibility for any hypothetical damages that may arise from the use of such information.

The Owner will not respond for causes beyond its control, among which may be listed in a non-limiting way: force majeure, problems accessing the Internet, technological problems beyond the diligent and reasonable management of the Owner, actions or omissions of third parties, etc. In all the aforementioned cases, beyond the control and due diligence of the Owner, there will be no obligation of compensation by the Owner to the User for damages or harm, to the extent permitted by current legislation.

Website Suspension

The Owner reserves the right to suspend, modify, restrict, or interrupt, whether temporarily or permanently, access, navigation, use, hosting and/or downloading of content and/or use of services on the Website, with or without prior notice, to Users who violate any of the provisions detailed in this Legal Notice, without the User's right to demand any compensation for this reason.

Confidentiality and Data Protection

In accordance with the provisions of Organic Law 15/1999, of December 13, on the Protection of Personal Data, all personal data collected during the use of the Website will be processed in accordance with what is established in the Privacy Policy, which every User must expressly accept to be able to use and register in the system.

General

The headings of the different clauses are only informative and will not affect, qualify, or expand the interpretation of this Legal Notice. Likewise, the Owner may modify the terms and conditions stipulated here, in whole or in part, by publishing any changes in the same way that this Legal Notice appears or through any type of communication addressed to Users.

The temporary validity of this Legal Notice, therefore, coincides with the time of its exposure, until it is totally or partially modified, at which time the modified Legal Notice will come into effect.

The Owner may terminate, suspend, or interrupt, at any time and without the need for prior notice, access to the contents of the Website, with no possibility for the User to demand any compensation. After this termination, the prohibitions of use of the contents outlined above in this Legal Notice will continue to be valid.

In the event that any provision of this Legal Notice is declared null or unenforceable, in whole or in part, by any competent Court, Tribunal, or administrative authority, this nullity or unenforceability will not affect the remaining provisions of this Legal Notice.

The non-exercise or execution by the Owner of any right or provision contained in this Legal Notice will not constitute a waiver thereof, except for acknowledgment and agreement in writing by their part.

Applicable Legislation and Competent Jurisdiction

This Website is governed by the current legislation in Spain.

For any controversy that may arise in the interpretation and application of this Legal Notice, and to the extent permitted by current legislation, both the Owner and the Users expressly submit to the jurisdiction of the Courts and Tribunals of Girona, waiving their own jurisdiction if applicable.
